Plantilla de VEHICLE CO-OWNERSHIP AND PARTNERSHIP AGREEMENT — 🇳🇬 Nigeria

This Vehicle Co-Ownership and Partnership Agreement is a private contract and not a government-mandated form in Nigeria. While not strictly required for official vehicle registration, it is highly recommended to clarify beneficial interests and responsibilities among co-owners. It serves as crucial supporting documentation for processes like applying for a change of ownership via Form MVA 5 at state Motor Vehicle Administration Agencies (MVAA) and updating records with the Central Motor Registry (CMR) under the Nigeria Police Force. For legal enforceability and evidentiary value, notarization or a sworn affidavit is strongly advised, and stamp duty may be payable on the agreement. Always ensure compliance with the National Road Traffic Regulations 2012 and consult state-specific MVAA requirements.

Sobre esta Plantilla de VEHICLE CO-OWNERSHIP AND PARTNERSHIP AGREEMENT

Two or more people buying a vehicle together — splitting the cost of a car, van, or commercial vehicle — need an agreement covering something a single owner never has to think about: how usage, running costs, and any eventual sale get divided between them.

Without one, disputes over who pays for fuel, who's responsible for a dent, or who gets the car on a given day are common, and resolving them without anything written down usually means falling back on the default provisions of the Partnership Act — which typically assumes equal shares regardless of what each person actually contributed. A written agreement avoids that by setting out ownership percentages, initial contributions, and how costs and usage are actually meant to be split from the start.

Nigerian vehicle registration only lists a single owner — there's no mechanism for listing multiple names on the official papers — so this agreement functions as internal proof of the real, beneficial ownership arrangement between the parties, separate from whatever the registration document says. It should record full details for each co-owner (names, addresses, NIN, or CAC/RC number for a company), a complete description of the vehicle, each party's ownership share and financial contribution in Naira, how running costs and maintenance responsibilities are divided, and how usage is scheduled if that matters for the arrangement.

The clause that matters most, and the one people skip most often, covers what happens when someone wants out. A buyout mechanism, or a clear process for selling the vehicle and dividing proceeds, is what keeps a disagreement from turning into a deadlock — without it, one co-owner wanting to exit is exactly the situation where these arrangements tend to fall apart. It's worth adding a dispute resolution clause too, generally favoring mediation or arbitration over going straight to court, and confirming Nigerian law governs the agreement.

This is a private contract, not something registered with the FRSC or MVAA, so it's enforceable as an ordinary agreement under Nigerian contract law rather than through any specific vehicle statute. Getting it notarized and paying any applicable stamp duty strengthens its evidentiary value if it's ever challenged, and it's worth ensuring all co-owners are named on the insurance policy so coverage actually reflects who has an interest in the vehicle.

Decide upfront how a co-owned vehicle gets sold or valued if one partner wants out later; that's the point where informal co-ownership arrangements most often break down.
